Acceza Acceptable Use Policy
The Acceptable Use Policy (AUP) in this document, including the list of Prohibited Activities mentioned below, is an integral part of your Hosting and Service Agreement with Acceza Technology. Acceza Technology may suspend or terminate your account if you take part in any of the activities prohibited by this AUP document.
This Acceptable Use Policy (AUP)is designed for the Services provided by Acceza Tech in orderto help in protecting Acceza, its customers, and the internet community generally from irresponsible and illegal activities. This Policy is a comprehensive list of the actions prohibited by Acceza Tech, and Acceza Tech reserves the right to modify the Policy at any time.
Prohibited Uses of Acceza Tech's Systems and Services
Violating Copyrights & Trademarks:
Transmission, distribution or storing of any material in infringement of any applicable law or regulation is strictly prohibited. This comprises without limitation, copyright protected material, trade secret, trademark or other intellectual property right used absent proper authorization, and material that is obscene, denigrating, constitutes an illegal threat, or violates export control laws.
Distributing Spam Email:
Sending any form of unsolicited bulk email through Acceza's email service is prohibited. Same as, sending of unsolicited bulk email from another service provider in the purpose of advertising a website, email address, or utilizing any resource hosted on Acceza's servers is prohibited. Acceza’s accounts or services may not be used for soliciting customers to collect replies to, or messages sent from another internet service provider where this Policy is violated by those messages or that of the other provider.
Unsolicited Mailing Lists:
Without direct and verifiable permission of the email address owner, subscribing email addresses to any mailing list is prohibited. All mailing lists run by Acceza customers need to be confirmed opt-in. The subscription confirmation message that’s received from each address owner must be kept on file for the duration of existence of the mailing list. Purchasing email address lists from third-parties for mailing to or from any domain hosted on Acceza, or referencing any Acceza account is prohibited.
Prohibited & Illegal Software:
Advertising, transmitting, or making available of any product, service, software, or program that is designed in the purpose of violating this AUP or any other internet service provider’s AUP, with but not limited to, the facilitation of the means for sending unsolicited bulk email, flooding, mail-bombing, initiation of pinging, distributed denial of service attacks.
Known Spam Operations:
Operating an account on behalf of, or reselling any service to, or in connection with, any person or firm listed in the database of Spamhaus Register of Known Spam Operations (ROKSO) at www.spamhaus.org/rokso is prohibited.
Hacking & Cracking:
An unauthorized attempt by any user to gain access to an account or computer resource which does not belong to that user (e.g. hacking, cracking) is prohibited.
Hacking Our Service:
Obtaining or making an attempt to obtain service by any means or device with the intention of avoiding payment is prohibited.
Hacking Our Users:
Unauthorized access, alteration, destruction, or making any attempt by any means or device to obtain any information of any customer or end-user of Acceza is prohibited.
DoS & DDoS Attacks:
Involving in any activity designed to harass, or making denial-of-service attack to anyone whether on the network of Acceza or another provider is prohibited.
Interfering with Acceza’s network that is used by other customers or authorized users using the services provided by Acceza is prohibited.
Customer's Responsibility for their Users
Each Acceza customer is held responsible for the activities of its users, and by accepting Acceza’s service, is agreeing to guarantee that its customers, representatives or end-users are abide by this Policy. Complaints about customers, representatives or end-users of a customer of Acceza will be forwarded to the customer's postmaster for taking action, otherwise be handled accordingly as required by the law.
Right to Terminate Service
If any violation of the Acceza’s AUP occurs, Acceza reserves the right to terminate services immediately and take action to stop the offending customer from violating Acceza’s AUP with or without notice as Acceza deems appropriate.
Cancellation requests must be received minimum30 days prior to the date the cancellation will take effect on the account. If you decide to cancel your account, please open a support ticket by logging into our client portal or send an email to our support email address. We reserve the right to terminate, suspend or cancel services immediately for violating any of our policies or your failure to pay fees by the due date, and therefore you will not receive refund of any fees.
You are held responsible for any fee and/or charge set out for any service issued. The fees will be due monthly basis if a due date is not set out. Setup fees are non-refundable for any reason. Fees will also not be refunded if you violate any Agreement or our AUP, and any Agreement will automatically be terminated for that violation. Our obligation for providing Services is depending on your payment of the fees by the due date. You are responsible to ensure that we receive your payment of the fees. Fees will be considered as paid on the date your payment becomes available to us. Acceza will use personal information of the customers only as reasonably necessary for providing contracted services to collect fees owed. Such information will not be disclosed to any third-party but if required by law as evidenced by a court order of competent jurisdiction and to collect services if needed. The customer empowers Acceza to use its name, business name and remarks in marketing documents for promotional activities and as reasonably necessary. The customer can send a written notice at any time to withdraw such empowerment.
Acceza will not be held obligated under any circumstances to provide insurance coverage for any data or Equipment owned by the customer and hosted in the premises.
